Important Notice

By agreeing to these Terms, you are legally bound by all provisions below. Please read the entire document carefully before using the Service. In particular, please review the Disclaimers, Limitation of Liability, and Dispute Resolution sections. If you do not agree to these Terms, you may not use the Service.

These Terms of Service (hereinafter "Terms") govern the use of the D-mail service (hereinafter "Service") and set forth the rights, obligations, responsibilities, and other necessary matters between the service operator 'dmail' (hereinafter "Company") and the user. By using the Service or creating an account, you are deemed to have agreed to all conditions of these Terms.

Article 1 (Purpose and Definitions)

1. Purpose

The purpose of these Terms is to set forth the conditions and procedures for using the D-mail Service provided by the Company, the rights and obligations of the Company and users, and other necessary matters.

2. Definitions

  • β€’"Service" means the email notification bot, web dashboard, AI-powered convenience features, related websites, APIs, software, and all associated features provided by the Company.
  • β€’"User" means any individual, corporation, or organization that uses the Service in accordance with these Terms.
  • β€’"Account" means the Discord account and linked email account information used by the User to access the Service.
  • β€’"Content" means all information, data, text, images, and other materials transmitted, stored, or processed through the Service.
  • β€’"Paid Services" means the premium features and additional services offered by the Company for a fee.
  • β€’"AI Features" means artificial intelligence-based supplementary features utilizing the Google Gemini API, including email verification code extraction, email summarization, and similar functions.
  • β€’"IMAP Service" means the email integration feature that connects non-Gmail email providers via the IMAP protocol.
  • β€’"Contacts" means email recipient information (groups, email addresses, display names, etc.) stored by the User within the Service.
  • β€’"Channel Forwarding" means the feature that automatically forwards email notifications to a specific Discord channel.
  • β€’"Web Dashboard" means the web-based interface through which the Service can be managed via a browser.
  • β€’"Company" means 'dmail' (website: dmailbot.com), the operator of this Service.

Article 2 (Effectiveness and Amendments)

1. Effectiveness

  • β€’These Terms take effect when posted on the Service screen or otherwise communicated to users.
  • β€’By using the Service, you are deemed to have agreed to these Terms.

2. Amendments

  • β€’The Company may amend these Terms for reasonable cause, and will notify users of any changes through in-service announcements, email notifications, Discord notifications, or other appropriate methods.
  • β€’Amended Terms take effect 7 days after notice. However, changes that are materially adverse to users will have a 30-day grace period.
  • β€’If you continue to use the Service after the effective date of amended Terms, you are deemed to have agreed to the amended Terms.
  • β€’Users who do not agree to the amended Terms may discontinue use of the Service and delete their account.

Article 3 (Provision of Services)

1. Scope of Services

The Company provides the following services. However, the specific content, scope, and quality of the services may be changed in accordance with Company policy.

2. Service Level

  • β€’The Service is provided "AS IS" and "AS AVAILABLE."
  • β€’The Company does not guarantee uninterrupted, error-free, or secure operation of the Service.
  • β€’The Company is not responsible for any delays, omissions, or errors in notification delivery.
  • β€’AI Features depend on third-party AI models, and the Company does not guarantee their accuracy, completeness, or timeliness.
  • β€’IMAP integration may be limited depending on whether the User's email provider supports it.
  • β€’The Company may change the feature and capacity limits of the free Service (such as the number of contact groups, email accounts, etc.) without prior notice.

Article 4 (Formation of Agreement)

1. Formation of Contract

  • β€’The service agreement is formed when the User agrees to these Terms, applies to use the Service, and the Company accepts the application.
  • β€’Application to use the Service is made through methods such as inviting the Discord bot, completing OAuth authentication, or logging into the web dashboard.

2. Eligibility

  • β€’Only individuals aged 14 or older, or legally established entities, may use the Service.
  • β€’Minors must obtain consent from a parent or legal guardian. If a minor uses the Service without such consent, the parent or legal guardian may cancel the agreement.

3. Refusal and Reservation of Acceptance

The Company may refuse an application or subsequently terminate the agreement in the following cases:

  • β€’The applicant has used another person's identity or provided false information
  • β€’The applicant has previously had service access restricted due to a violation of these Terms
  • β€’The application is deemed likely to interfere with the operation of the Service
  • β€’The applicant otherwise fails to meet the requirements established by the Company

Article 5 (Account Management and Security)

1. Account Management Responsibility

  • β€’Users are responsible for securely managing their account information, including Discord accounts, linked email accounts, and OAuth tokens.
  • β€’Users may not transfer, lend, or share their account with any third party.
  • β€’The Company is not liable for any damages arising from unauthorized use of an account.

2. IMAP and Web Authentication Management

  • β€’Users are responsible for the accuracy and security of authentication credentials they directly enter, such as IMAP app passwords.
  • β€’Users are responsible for managing their Web Dashboard sessions. Any damages caused by failure to log out on shared devices are attributable to the User.

3. Security Incident Notification

  • β€’Users must notify the Company immediately upon becoming aware of any security incident, such as account theft or unauthorized access.
  • β€’The Company is not liable for any additional damages resulting from delayed notification.

Article 6 (User Obligations)

Users must comply with the following:

  • β€’Comply with these Terms and all applicable laws and regulations.
  • β€’Provide and maintain accurate and up-to-date information.
  • β€’Use the Service only for lawful and ethical purposes.
  • β€’Not interfere with other users' use of the Service.
  • β€’Not use the Service for commercial purposes without the prior written consent of the Company.
  • β€’Not engage in any activity that disrupts the normal operation of the Service.

Article 7 (Prohibited Activities)

Users must not engage in the following activities:

1. Illegal and Harmful Activities

  • β€’Using the Service for illegal purposes such as spam, phishing, or malware distribution
  • β€’Unauthorized collection, storage, or disclosure of other individuals' personal information or email content
  • β€’Transmitting pornographic, violent, or hateful content
  • β€’Defaming or infringing upon the rights of others

2. Technical Interference

  • β€’Reverse engineering, decompiling, or attempting to extract source code from the Service
  • β€’Bypassing security measures, exploiting vulnerabilities, or attempting unauthorized access
  • β€’Making bulk requests using bots, scripts, or automation tools
  • β€’Placing excessive load on the Service infrastructure
  • β€’Copying, modifying, distributing, or creating derivative works of the Service

3. Service Abuse

  • β€’Using the Service beyond the usage limits established by the Company
  • β€’Using the Service to provide similar services to third parties
  • β€’Any other activity that disrupts the normal operation of the Service

4. AI, Forwarding, and Contact-Related Prohibited Activities

  • β€’Abusing AI Features to attempt mass email processing
  • β€’Systematically collecting or reprocessing AI Feature results for use in other services
  • β€’Sharing others' emails without authorization through Channel Forwarding
  • β€’Using the Contacts feature for spam or mass email distribution

Article 8 (Service Restrictions and Termination)

1. Service Restrictions

The Company may restrict service use or suspend accounts without prior notice in the following cases:

  • β€’Violation of these Terms
  • β€’Suspected or confirmed illegal activity
  • β€’Causing harm to other users or the Company
  • β€’Posing a threat to the security of the Service
  • β€’Request from a legal authority or government agency

2. Termination

  • β€’Users may discontinue use of the Service and delete their account at any time.
  • β€’The Company may immediately terminate the agreement in the event of a material violation of these Terms.
  • β€’Upon termination, User data will be deleted to the extent permitted by applicable law. Some information may be retained for compliance with legal obligations.

3. Appeals

  • β€’Users who object to service restrictions may submit supporting documentation to the Company to file an appeal.
  • β€’The Company will review the appeal and notify the User of the result within 30 days.

Article 9 (Service Suspension and Changes)

1. Service Suspension

The Company may temporarily suspend or terminate the provision of the Service for the following reasons:

  • β€’System inspection, maintenance, or upgrades
  • β€’Force majeure events such as natural disasters, war, terrorism, or pandemics
  • β€’Interruption of service by telecommunications providers
  • β€’Outages or policy changes by third-party services such as Google or Discord
  • β€’Response to security threats or emergencies
  • β€’Business reasons that make continued operation of the Service impracticable
  • β€’API policy changes, outages, or termination of AI service providers (such as Google Gemini)

2. Service Changes

  • β€’The Company may modify, add to, or discontinue all or part of the Service.
  • β€’Material changes will be announced in advance. However, in urgent circumstances, notice may be given after the fact.
  • β€’The Company may change the AI model, provider, or processing methods of AI Features without prior notice, and is not liable for any resulting changes in service quality.

3. Service Termination

  • β€’The Company may terminate the Service with 30 days' prior notice.
  • β€’The Company shall not be liable for any damages arising from service termination, except in cases of willful misconduct or gross negligence.

Article 10 (Paid Services and Payment)

1. Paid Services

  • β€’The Company may offer paid services in addition to the free Service.
  • β€’Details regarding the content, pricing, and payment methods of paid services will be provided separately.
  • β€’The Company may change the pricing of paid services and will provide prior notice of any changes.

2. Payment

  • β€’Users shall pay fees using the payment methods designated by the Company.
  • β€’For recurring subscription services, charges will automatically renew unless cancelled by the User.
  • β€’Service access may be restricted in the event of payment failure.

3. Taxes and Fees

  • β€’Displayed prices include applicable taxes unless otherwise stated.
  • β€’Third-party fees, including payment processing fees and currency conversion fees, are the responsibility of the User.

Article 11 (Refund Policy)

1. Payment Processor

Payments for Paid Services are processed by Paddle.com (Paddle.com Market Limited and its affiliates, hereinafter "Paddle") acting as the Merchant of Record. All purchases, tax handling, and refunds are governed by Paddle's policies and procedures.

2. Refund Principles

  • β€’You may request a refund within 14 days of the purchase date.

3. Refund Restrictions

Refunds may be restricted in the following cases:

  • β€’Service access was suspended or terminated due to a violation of these Terms

4. Refund Procedure

  • β€’Refund requests should be submitted through our customer support channel ([email protected]) or directly via Paddle's customer support.
  • β€’Refund processing times may vary depending on Paddle's procedures.

Article 12 (Intellectual Property)

1. Company's Rights

  • β€’All intellectual property rights in the Service and all content, technology, designs, trademarks, logos, and software contained therein belong to the Company.
  • β€’Users may not reproduce, modify, distribute, sell, or license any of the foregoing without the prior written consent of the Company.

2. License Grant

  • β€’The Company grants Users a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
  • β€’This license is valid only for personal, non-commercial use.

Article 13 (Data and Content)

1. User Content

  • β€’Users retain all rights to Content transmitted through the Service, such as email content.
  • β€’Users grant the Company a license to use, reproduce, and transmit such Content to the extent necessary for providing the Service.

2. Data Backup

  • β€’The Company has no obligation to back up or preserve User data.
  • β€’Users are responsible for maintaining their own separate backups of their data.

3. Data Deletion

  • β€’Upon account deletion or service termination, User data will be deleted within a reasonable period.
  • β€’Some data may be retained for compliance with legal obligations, dispute resolution, or prevention of service abuse.

4. AI Processing

  • β€’When AI Features are used, portions of email content are transmitted to a third-party AI service (Google Gemini API).
  • β€’The Company does not separately store data processed through AI Features.
  • β€’Users are responsible for independently verifying the accuracy of AI processing results.
  • β€’The Company is not liable for the data processing practices of third-party services used through AI Features.

Article 14 (Disclaimers)

This section contains important provisions that limit the Company's liability. Please read carefully.

1. Service-Related Disclaimers

  • β€’The Company does not warrant the uninterrupted operation, error-free performance, security, or accuracy of the Service.
  • β€’The Company is not liable for any damages caused by delays, omissions, or errors in email notifications.
  • β€’The Company is not liable for any loss of User data.
  • β€’The Company does not warrant the accuracy, completeness, or timeliness of AI-based features (verification code extraction, email summarization, etc.), and is not liable for any damages arising from reliance on AI results.
  • β€’The Company is not liable for the exposure of email content forwarded to public channels through the mail forwarding feature.
  • β€’The Company is not liable for service disruptions caused by errors in user-provided IMAP settings.

2. Third-Party Disclaimers

  • β€’The Company is not liable for any issues arising from outages, policy changes, or service termination of third-party services such as Google or Discord.
  • β€’The Company does not intervene in or assume responsibility for disputes between Users and third parties.

3. Other Disclaimers

  • β€’The Company is not liable for any damages caused by User fault, including configuration errors, negligent account management, or network issues.
  • β€’The Company is not liable for any damages caused by force majeure events such as natural disasters, war, or government actions.
  • β€’The Company assumes no liability whatsoever for services provided free of charge.

4. AI Feature Disclaimers

  • β€’The Company makes no warranties whatsoever regarding the accuracy, completeness, or timeliness of AI Feature results (verification code extraction, summarization, etc.).
  • β€’The Company is not liable for any direct or indirect damages caused by errors, omissions, or misidentifications by AI Features.
  • β€’The Company is not liable for changes to AI models, performance degradation, or service interruptions.

5. IMAP Service Disclaimers

  • β€’The Company is not liable for any issues arising from the User's email service provider blocking or restricting IMAP access.
  • β€’The Company is not liable for missed or delayed email reception caused by errors in User-provided IMAP settings.

6. Channel Forwarding Disclaimers

  • β€’The User who configured Channel Forwarding bears full responsibility for any exposure of email content to other users within the Discord server resulting from the forwarding configuration.

Article 15 (Limitation of Liability)

1. Scope of Liability

  • β€’Except in cases of willful misconduct or gross negligence, the Company's total liability shall not exceed the amount paid by the User during the preceding 12-month period.
  • β€’For users of the free Service, the Company's liability is zero.

2. Excluded Damages

To the maximum extent permitted by law, the Company shall not be liable for the following damages:

  • β€’Indirect, incidental, special, consequential, or punitive damages
  • β€’Loss of business, revenue, data, or opportunity
  • β€’Damages arising from service interruption or data corruption
  • β€’Damages arising from unauthorized access or data tampering

3. AI Features and Free Service Liability Limitation

  • β€’The Company's liability for damages related to AI Features is limited to the amount directly paid by the User for such features.
  • β€’The Company bears no financial liability whatsoever for features provided free of charge (including AI verification code extraction).

Article 16 (Indemnification)

1. User's Indemnification Obligation

Users shall indemnify the Company for all damages, costs, and claims arising from the following:

  • β€’Violation of these Terms
  • β€’Violation of applicable laws and regulations
  • β€’Infringement of third-party rights, including intellectual property rights and privacy
  • β€’Disputes arising from User Content

2. Hold Harmless

  • β€’Users shall indemnify, defend, and hold the Company harmless from any related claims, lawsuits, and damages.
  • β€’This includes all costs, including reasonable attorney's fees.

Article 17 (Third-Party Services)

1. Use of Third-Party Services

The Service integrates with the following third-party services:

  • β€’Google LLC β€” Gmail API (email integration), Gemini API (AI Features)
  • β€’Discord Inc. β€” Discord Bot API (notifications and commands), Discord OAuth (Web Dashboard authentication)
  • β€’Resend Inc. β€” Email delivery (account deletion confirmation, etc.)
  • β€’Dmailsend β€” SMTP relay (email sending relay for IMAP accounts)
  • β€’IMAP email service providers connected by the User
  • β€’Users must also agree to the terms of service and privacy policies of those third-party services.
  • β€’When AI Features are enabled, email content is transmitted to the Google Gemini API, and Google's data processing policies apply.

2. Third-Party Service Disclaimers

  • β€’The Company does not warrant the availability, accuracy, or security of third-party services.
  • β€’The Company is not liable for any issues arising from changes, outages, or termination of third-party services.

Article 18 (Privacy)

  • β€’The collection, use, storage, and disposal of personal information are governed by the Privacy Policy.
  • β€’By using the Service, you are deemed to have also agreed to the Privacy Policy.
  • β€’The Privacy Policy forms an integral part of these Terms.

Article 19 (Dispute Resolution)

1. Governing Law

  • β€’These Terms shall be governed by and construed in accordance with applicable law in the jurisdiction where the Company is established.

2. Jurisdiction

  • β€’Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the jurisdiction where the Company's principal place of business is situated.

3. Dispute Resolution Procedure

  • β€’In the event of a dispute, the parties shall first attempt to resolve the matter amicably through the customer support channel.
  • β€’If an amicable resolution cannot be reached, either party may pursue legal proceedings.

Article 20 (General Provisions)

1. Entire Agreement

  • β€’These Terms constitute the entire agreement between the Company and the User with respect to the use of the Service.

2. Severability

  • β€’If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

3. No Waiver

  • β€’The failure of the Company to exercise any right under these Terms shall not constitute a waiver of that right.

4. Assignment

  • β€’Users may not assign or transfer their rights or obligations under these Terms to any third party without the prior consent of the Company.
  • β€’The Company may assign its rights and obligations under these Terms in connection with a business transfer, merger, or similar transaction.
